The Terms and Conditions contained herein shall apply to any person (“User”)
using the services of HEM GURUKOOL SCHOOL herein after called “SCHOOL” for
making Fee payment through an online payment gateway service (“Service”) offered
through the RBI approved online payment Aggregator ‘CITRUS Payment Solution Pvt.
Ltd.’ by ‘Alpha Data Management Services’. By clicking on acceptance of terms
and conditions you are hereby agreeing to accept the below mentioned applicable
terms and conditions for effecting/making the fees payment through Online
platform made available by Alpha Data Management Services through the RBI
approved online payment Aggregator ‘CITRUS Payment Solution Pvt. Ltd.’, Viz: |

A. General Terms and Conditions for Online-Payments :
|
|
|
|
1. Once a User has accepted these Terms and Conditions, he/ she may avail the
Services. A User may pay his school fees as new student or by entering his/her
GRN number and pay their dues/ fees specified by SCHOOL from time to time.
2. SCHOOLS’ rights, obligations, undertakings shall be subject to the laws in
force in India, as well as any directives/ procedures of Government of India,
and nothing contained in these Terms and Conditions shall be in derogation of
SCHOOLS’ right to comply with any law enforcement agencies request or
requirements relating to any User’s use of the website or information provided
to or gathered by SCHOOL with respect to such use. Each User accepts and agrees
that the provision of details of his/ her use of the Website to regulators or to
any other third party in order to resolve disputes or complaints which relate to
the Website shall be at the absolute discretion of SCHOOLS and or Technical
Service Provider.
3. If any part of these Terms and Conditions are determined to be invalid or
unenforceable pursuant to applicable law including, but not limited to, the
warranty disclaimers and liability limitations set forth herein, then the
invalid or unenforceable provision will be deemed superseded by a valid,
enforceable provision that most closely matches the intent of the original
provision and the remainder of these Terms and Conditions shall continue in
effect.
4. Refund or Charge Back Transaction: In the event there is any claim for/ of
charge back or Refund by the User for any reason whatsoever, such User shall
immediately approach SCHOOLS with his / her claim details for any refund /
Chargeback. No claims for refund/ charge back shall be made by any User to the
Payment Service Provider(s) and in the event such claim is made it shall be
entertained at the sole discretion of SCHOOL.
5. Server Slow Down/Session Timeout: In case the Website or Payment Service
Provider’s webpage, that is linked to the Website, is experiencing any server
related issues like ‘slow down’ or ‘failure’ or ‘session timeout’, the User
shall, before initiating the second payment, check whether his/her Bank Account
has been debited or not and accordingly resort to one of the following options:
(I) In case the Bank Account appears to be debited, ensure that he/ she does not
make the payment twice and immediately thereafter contact SCHOOL via e-mail or
any other mode of contact as provided by SCHOOL to confirm payment.
(ii) In case the Bank Account is not debited, the User may initiate a fresh
transaction to make payment. However, the User agrees that under no
circumstances the Payment Gateway Service Provider shall be held responsible for
such fraudulent/duplicate transactions and hence no claims should be raised to
Payment Gateway Service Provider. No communication received by the Payment
Service Provider(s) in this regards shall be entertained by the Payment Service
Provider(s). |

B. No Third Party Payment :
|
|
|
|
1. The User agrees that the debit/credit card details provided by him/ her for
use of the aforesaid Service(s) must be correct and accurate and that the User
shall not use a debit/ credit card, that is not lawfully owned by him/ her or
the use of which is not authorized by the lawful owner thereof. The User further
agrees and undertakes to provide correct and valid debit/credit card details.
2. The User may pay his/ her fees to SCHOOL by using a debit/credit card or
through online banking account. The User warrants, agrees and confirms that when
he/ she initiates a payment transaction and/or issues an online payment
instruction and provides his/ her card / bank details. The User is fully and
lawfully entitled to use such credit / debit card, bank account for such
transactions.
3. The User is responsible to ensure that the card/ bank account details
provided by him/ her are accurate. The User is authorizing debit of the
nominated card/ bank account for the payment of fees selected by such User along
with the applicable Fees. The User is responsible to ensure sufficient credit is
available on the nominated card/ bank account at the time of making the payment
to permit the payment of the dues payable or the bill(s) selected by the User
inclusive of the applicable Fee. |

C. Personal Information :
|
|
|
|
1. The User agrees that, to the extent required or permitted by law, SCHOOLS
and/ or the Payment Service Provider(s) may also collect, use and disclose
personal information in connection with security related or law enforcement
investigations or in the course of cooperating with authorities or complying
with legal requirements.
2. The User acknowledges and agrees that his/ her information will be managed in
accordance with the laws for the time in force. |

D. Payment Gateway Disclaimer :
|
|
|
|
The Service is provided in order to facilitate access to view and pay Student
Fees online. SCHOOL or the Payment Service Provider(s) do not make any
representation of any kind, express or implied, as to the operation of the
Payment Gateway other than what is specified in the Website for this purpose. By
accepting/ agreeing to these Terms and Conditions, the User expressly agrees
that his/ her use of the aforesaid online payment Service is entirely at own
risk and responsibility of the User.
You are about to access a third party site
for the online Payment gateway services, the accuracy or completeness of the
information, materials, services or the reliability of any service, advice,
opinion, statement or other information displayed or distributed through it. You
shall access the third party site solely for the purposes of fees payment and
you understand and acknowledge that availing of any services offered on the
site, sharing of information with Payment gateway Service Provider or any
reliance on any opinion, advice, statement, memorandum, or information made
available by you on the site shall be at your sole risk. |

E. Indemnification :
|
|
|
|
You agree to indemnify and hold Alpha Data Management Services, its parents,
subsidiaries, affiliates, officers, agents, co branders or other partners and
employees, harmless from any claim, demand, or damage, including reasonable
attorneys' fees, asserted by any third party due to or arising out of your use
of or conduct on the Service. |

F. Jurisdiction:
|
|
|
|
Any transaction carried out through online fess payment platform made available
by SCHOOL, shall always be subject to laws of India and shall be subject to
exclusive jurisdiction of competent courts at Pune City. |

|
|
|
|
|
|
G. Interpretation :
|
|
|
|
Headings, bold, italicized and other stylized typefaces are only for convenience
and shall not be considered for the purposes of interpretation/construction of
any provision or interpretation of the same under this document. |

|
H. Modifications To Terms of Service, Member Policies :
|
|
|
|
Alpha Data Management Services reserves the right at any time and from time to
time, at its sole discretion, to modify or discontinue, temporarily or
permanently, in part or in whole, the Service, TOS or policies regarding the use
of the service with or without notice. You agree that Alpha Data Management
Services shall not be liable to you or to any third party for any modification,
suspension or discontinuance of the Service. Your continued use of the Service
shall be deemed as an unconditional acceptance of these changes. |

I. Notices, Transaction Records and Electronic Disclosures :
|
|
|
|
Notices to you may be made via either email or by delivery by hand /regular mail
to the address provided by you. The Service may also provide notices of changes,
to either the TOS or other matters, by way of publication in newspapers or by
displaying notices or links to notices on the Service.
All such notices will have the same effect as a notice served individually to
you. Notices and instructions will be deemed served 7 days after posting or upon
receipt in the case of hand delivery, cable, telex, through internet or
facsimile (fax). Alpha Data Management Services may be required to provide to
you certain disclosures and notices, which are mandated by various laws and
rules and transaction related notifications such as receipt of bill details,
payment advices, payment return advices etc.
You acknowledge and agree to receive all such disclosures and notifications
electronically, which, in most cases, will be done through the Internet. If, for
any reason, you do not wish to receive the disclosures electronically, you must
advise Alpha Data Management Services immediately. In such an event, Alpha Data
Management Services reserves the right to discontinue/terminate the provision of
the Service to you, in whole or in part. You acknowledge that the read-out,
faxed, email or printed output, if any, that is generated at the time of
operation of your account under the Service is a record of the operation by you.
The records of Alpha Data Management Services, generated by the transactions
arising out of the use of the Service, including the time the transaction is
recorded shall be conclusive proof of the genuineness and accuracy of the
transaction. You acknowledge that Alpha Data Management Services shall have no
liability or obligation to keep a record of the transactions carried through the
Citrus Pay Service and/or to provide information to you or for verifying your
Payment Instructions, other than records required to be kept or information
required to be provided statutorily by Alpha Data Management Services.
You acknowledge that Alpha Data Management Services does not pre-screen the data
presented by Payees(s), but that Alpha Data Management Services shall have the
right (but not the obligation) in its sole discretion to refuse or curtail any
content/data that is available via the Service.
Without limiting the foregoing, Alpha Data Management Services shall have the
right to remove any content/data that violates the TOS or is otherwise in
violation of any contract entered into by Alpha Data Management Services. You
agree that you must evaluate, and bear all risks associated with, the use of any
content/data, including any reliance on the accuracy, completeness, or
usefulness of such content/data. |
